RECENTLY ENACTED NYS LAWS NOW IMPOSE TOUGHEST PENALTIES POSSIBLE FOR MOTORISTS! AS OF JUNE 1, 2013 TEXTING AND OR DISTRACTED DRIVING IS A 5 POINT OFFENSE! THE NYS DMV HAS ALSO EXTENDED THE LOOK-BACK PERIOD FOR PRIOR CONVICTIONS TO 25 YEARS!

Saratoga Springs NY- If it wasn't clear to the citizens of New York State that alcohol related and/or traffic violations can mean dire consequences, it should be now. New York State legislators along with the NYS Department of Motor Vehicles have put together a virtual "Pandora's Box" of laws that could have dire and unexpected consequences for many motorists for even the smallest of traffic infractions and most definitely for any alcohol related offense.

As of June 1, 2013, a ticket for texting while driving or anything deemed as distracted driving will carry a fine of $50 to $150 along with 5 points added to license. A second offense committed within 18 months will carry a fine of $50 to $200 and 5 points added to license. A third or subsequent offense committed within 18 months will carry a fine of $50 to $400 and 5 points added to license. Young drivers will face further consequences if in a probationary period or a junior operator. In these cases, licenses will be suspended for 60 days for violations like speeding, reckless driving, or following too closely behind another vehicle. Licenses will be revoked for 6 months (for probationary licenses) or 60 days (for junior licenses).

As of July 1, 2013 the DMV in combination with Law Enforcement Officials will now be using a 25 year "look-back" period which is up from a 10 year look-back period. This means that offenses 25 years ago can be combined with a current offense and used as a cumulative point system. For example, points from a speeding ticket from 15 years ago could be combined with a current ticket and or motor vehicle related arrest. Additionally, all speeding violations and offenses are looking back 25 years and licenses can be revoked for a cumulative total of 20 points over 25 years! The compounding effect of these laws is staggering and many people are unaware of the changes.

Beginning September 23, 2013 even greater consequences regarding license revocations and restorations will take effect which will make it much more difficult for some to obtain a conditional license as well as much longer waiting periods for restoration. In many cases licenses can be revoked for life! For example, if five alcohol/drug related incidents are accumulated over a 25 year period or four or more alcohol related plus one Serious Driving Offense and you are deemed a "persistently dangerous driver", the license can be revoked for life.
